White Castle Litigation Ongoing with Township

Township recently submitted a briefing schedule to the court

The township is still caught up in litigation with White Castle, most recently submitting a briefing schedule to the court, Planning Board Attorney Joseph Coronato said. “There really has been no attempt to settle it,” Coronato said at Lacey’s latest Planning Board meeting. It was announced that White Castle sued the township for the restrictions the Planning Board placed on its hours of operation in September. White Castle’s application was approved to be built at the intersection of Route 9 and Sunrise Boulevard but rather than being open 24-hours, as the company had sought, the Planning Board restricted the hours of operation to 6 a.m. to 1 a.m. The Planning Board previously cited a 24-hour operation as being disruptive to the community…

I live her in Forked River, i love this town and wonder why anyone would want to stop a good reputable business from wanting to come here and bring jobs and tax dollars to town. I am even more baffled as to why the board made the decision they made, even if all of the 60 people spoke against White Castle being open 24 hours. Dollar General Withdraws Application, Leaves No Indication of Return

The general merchandise store is no longer being proposed in between Railroad Avenue and the Forked River School

The township Planning Board approved Dollar General’s application withdrawal at the Tuesday night meeting. The applicant's attorney submitted a letter asking the board to withdraw the application. “The letter was very vague,” Committeeman and board member Gary Quinn said. The letter did not provide reasons as to why the application was withdrawn, he said. The general merchandise store was proposed at 120B Lacey Road, where an existing and occupied house sits, bordering Railroad Avenue and the Forked River School. It is possible Dollar General could return in the future, but the applicant provided no indication that they would, Quinn said. “I think they went to the county and didn’t get the answers they were looking for,” he said. White Castle to Conduct Traffic Study Prior to Planning Board Decision

Board says cross access to Sunrise Plaza will be a 'major key' to the project; White Castle will return for the June meeting

The Planning Board tabled the White Castle application until June after the engineer agreed to do a traffic study of the intersection of Route 9 and Sunrise Boulevard, the proposed location of the restaurant, during Memorial Day Weekend. With its only entrance and exit on Sunrise Boulevard, the applicant is proposing to make road improvements. An application has been submitted to the state Department of Transportation to widen Sunrise Boulevard on the White Castle frontage to increase access to the right turn lane. The middle lane would be converted to a dual through lane and a left turn lane. Bank of America Objects to Planning Boards Request to Install a Monument Sign

The Planning Board approved a resolution to make the Lacey Road Bank of America handicap accessible, although the applicant may seek to have it amended in the future

The township Planning Board approved a resolution to make the Lacey Road Bank of America handicap accessible. The application was originally approved in March pending several conditions, including demolishing the old sign and installing a monument sign. The applicant’s attorney Scott Collins of Riker, Danzig, Hyland & Perritti LLP objected to this condition. “If you propose a condition it needs to be designed to address or mitigate some land use impact associated with the application,” Collins said. “No such impact exists here. The sign is untouched. There’s just not factual basis for the condition and no legal justification.” Kim Pascarella, who served as the board attorney for this meeting, spoke to Joseph Coronato about the issue prior …

Lacey Road Bank of America to Become Handicap Accessible

Planning Board approves improvements upon several conditions

The Bank of America on Lacey Road in Forked River will become handicapped accessible after the township Planning Board approved its application pending several conditions. “The federal government working through state agencies as well as the county and township, they’re becoming more stringent on the enforcement of ADA (Americans with Disabilities Act) compliance,” said site engineer Charles D. Olivo of Stonefield Engineering & Design, LLC. The improvements to the Bank of America comply with the ADA by creating handicap access from Lacey Road to the building. Currently there is a curb off of the sidewalk on Lacey Road to the bank. A ramp will be made from the sidewalk. The applicant will also be repaving the parking lot. The Planning Board…

White Castle Deemed Technically Complete

White Castle will have a public hearing at the April 9 Planning Board meeting

The application for White Castle was deemed technically complete for public hearing by the township Planning Board. “I’m not digging that,” said Katie Bonacolta of Big League Barbers, a hair salon located at Sunrise Plaza, which is right next to the site where White Castle will be located. Although the fast food restaurant most likely won’t have a long-term effect on business, traffic will be impacted, she said. “Maybe it will be a little like Sonic (in Waretown),” she said. There was a boost in business for a short time after Sonic was built. “Traffic is just going to get worse.” White Castle will replace an existing dwelling at the intersection of Sunrise Boulevard and North Main Street. The appointments remain the same for 2012: Meeting times will remain the second Monday of the month, unless otherwise noted.
