Proposed Ordinance to 'Facilitate' Rebuilding for Some

If approved by township Committee, some residents in flood hazard areas will be able to elevate homes without zoning board approval

The Planning Board has recommended an ordinance to the township Committee that would allow residents living on an undersized lot in flood hazard areas to elevate without zoning board approval as long as they meet setback requirements. The amendment, if approved by the Committee, would "facilitate" the rebuilding process for residents who have been significantly impacted by Hurricane Sandy, Director of Community Development John Curtin said at a regular Planning Board meeting Monday. Residents living on undersized lots would be able to elevate their homes without zoning board approval as long as their plans meet setback regulations and do not require variances. But to elevate a home that rises above 35 feet would still require a variance, …

For Some in Lacey, An Easier Way to Elevate

Lacey's Zoning Board will recommend the township's Committee allow residents to raise their homes without zoning approval.

The idea is to expedite the recovery process, but a recommendation being made by the Lacey Township Zoning Board to allow residents to elevate their homes without zoning approval is wrought with exceptions and catches. During its workshop Monday night, the board agreed it would recommend to township Committee that it allow residents on conforming lots to elevate their preexisting homes to as high as 38 feet. The new height is three feet higher than the township’s current height allowance, and is designed to meet new elevations dictated by the Federal Emergency Management Agency’s (FEMA) Advisory Base Flood Elevation, or ABFE, maps. Lacey Homeowners Begin Rebuilding Process at Zoning Board

Three Lacey residents received approval from the Board of Adjustment to either demolish and rebuild or renovate and raise their homes after Sandy

Three Lacey homeowners gathered in a circle as the zoning officer gave them advice and directions after the Board of Adjustment approved their applications to renovate, raise and rebuild their homes following the destruction caused by Hurricane Sandy. David Petty, Angela Devoe and Brian Hunter were the first of four applicants to approach the board with plans to rebuild. Rebuilding Can be a ‘Relief’  Petty received approval from the board to rebuild his single-family dwelling, which he had intended to do prior to Hurricane Sandy. The secondary Koa Drive home, which will become his permanent residence once the new dwelling is completed, had taken on more than six feet of water due to the superstorm. I know it feels like an eternity of waiting but I know it will not be long before I am sitting in an adjustment board meeting getting the variances I will need to get my home back. Sandy Policy Enacted to Quicken Rebuilding Process for Homeowners

Residents who must restore or rebuild their homes after Sandy can do so within the same footprint without going before the Zoning Board of Adjustment

Due to the damage caused by Hurricane Sandy along Lacey’s waterfront areas, many homes may have to be rebuilt and to accelerate the process the Committee approved a Super Storm Sandy Reconstruction Policy for residential structures. “We’re trying to quicken up the pace of these approvals so that there’s not such a delay of two to three months and of course the costs associated with that,” Township Administrator and Municipal Clerk Veronica Laureigh said. The policy states that damaged homes situated below the base flood elevation and located on a nonconforming lot can be restored, rebuilt or raised or demolished and rebuilt with a new proposed structure as long as they are replaced in a conforming location.
