Officer Resigns After Accidental Shooting

Officer Gerard Noda recently resigned after his weapon accidentally discharged, injuring another officer

A Lacey Township police officer resigned after accidentally discharging his weapon recently, Chief William Nally said.

Officer Gerard Noda’s weapon accidentally discharged at approximately 8:50 p.m. on June 2, injuring Officer Julie Barcalow, Deputy Chief Michael Mohel of the Ocean County Prosecutor's Office previously said.

The incident occurred in the department’s squad room after a training exercise.

Barcalow was transported to Community Medical Center in Toms River where she was treated and released and has since returned to duty.

The incident was under an internal affairs investigation by the Lacey Township Police Department when Noda resigned in relation to the accident, Nally said. The department did not suspect criminal wrongdoing, he said.

Since Noda resigned prior to the completion of the investigation, no charges will be pressed, Nally said. The police department has ceased the investigation.

Noda was not immediately available for comment.

No, as I/we do not know. Just the fact this was a shooting with injuries demands a complete investigation. not what appears to be a back room deal. all jump to call it an accident . I call it a shooting until all the facts have checked and rechecked. maybe I seem to critical to some but any one who has handeled guns and knows them also knows they do not just fire unless you want them too.

"" but any one who has handeled guns and knows them also knows they do not just fire unless you want them too""" Skipper I beg to differ. Accidental discharges happen all the time.HOw many times do you read where people have killed or injured others while cleaning their gun. There are even mechanical issues which cause a gun to fire. I saw that first hand. My brother was nearly killed when a safety malfunctioned. A friend who is a police officer had an accidental discharge and put a round threw his refrigerator. He certainly did not want to shoot his refrigerator nor did the person who almost shot my brother want to have his gun go off.

Joe, If we were talking about a firearm that was very old and in need of repair then yes but that is not the case here. also cleaning any fire arm they need to be unloaded first before any cleaning can be done. are you thinking the officer plulled the triger to see if it was unloaded? if so that to would not be an accident but miss use of a fire arm. so I hope you understand why I can not call it a accident with out a complete investigation.

The only thing that the investigation would find is that he did not follow proper saftey protocol and his weapon discharged. I am positive that he did not mean to shoot his fellow officer and the incident is probably eating him up knowing what could have happened. He was given a choice to resign or to wait on the investigation and probably lose his gun for having this happen. Theres no conspiracy of lacey cops shooting each other and no big cover up. Just have some dignity and not demand a public lynching of this officer who is already out of a career and living with his mistake.
Joe August 25, 2011 at 05:28 PM
Thanks Dan. I am sure you have it correct. To think anything else is just using a vivid imagination.
WhyohWhy August 25, 2011 at 07:34 PM
You are both right I'm sure...just a shame a career is lost. And 'overtaxed' if you had better things to do then why are you on here voicing your opinion?LOL
Joe August 25, 2011 at 08:59 PM
"""" If patch didn't write about it .99% of lacey wouldnt know about it .and he would still be there protedting us .Thank you""""" You are kidding right? The Patch comments started the investigation and caused him to resign? There was not going to be any departmental investigation whatsoever? Or there was going to be an investigation but he would not be disaplined. He would told to be more carefull and that was it? FYI, any discharge of a weapon by a police officer other than on a range is always investigated!

Agreed Dan!

I must say I do not care for how Nally left everyone hanging from his 1/2 story. From Nallys remarks, Id be skeptical too. But I mysef witnessed what happened because I saw the tape. Noda was cleared of all criminal charges by the Ocean County Prosecutors office & Lacey Township Police Department investigation before he resigned. What was pending with Lacey was negligence charges from the accidental shooting. Wasnt it nice of Nally to state here the department did not suspect criminal wrong doing. Excuse me, the tape clearly shows it was an accident. There was no reason to suspect or not to suspect anything when you see the tape with your own eyes as he did. Also in reading Nallys lack of statement he makes it sound like Noda shot Barcalow directly. The fact is the bullet hit her cell phone & grazed her. I dont know why he did not state as such. Nally is the one whos making this story sound odd, like a cover up & they stopped the investigation because Noda resigned. Bologna. I am looking at a piece of paper from the department that states Noda couldve gotten anything from a reprimand to a termination. He took it upon himself to resign as it was a traumatic event & he still has not forgiven himself. He couldve hurt her. It was his error, he owned up to that & he no longer wants to touch a gun. I will continue story in the next post

My dad was a Newark police officer for 29 years & my first husband also was a Newark police officer for 10 years & I have never heard of stopping an investigation into a shooting because someone resigned. I dont know if Nally gave partial answers, or the writer only wrote certain answers. Your guess is as good as mine. But for the record in closing I would like to add.. they shouldve taped off the area to secure the scene & immediately secured the gun. Regardless of an accident, it is still a crime scene. But instead the officers walked through it, picked things up, moved things and never secured the weapon. It looked like yahoo night. Looks to me like more then Noda needed retraining. (moot point now) But the bottom line is Gerard is a decent guy who made an error in judgement for not realizing there was still a bullet in his chamber and his mistake cost him dearly. It was an accident none the less and for that he is sorry & that is all he can be, as you know you cant take back something that happened already. I just wanted to put to rest any fears of a cover up or lack of facts from this story. Even at the end of this story it states Noda was not available for comment... Thats too was odd as no one asked him for his comment... I dont know, may be that is standard writing procedure

I know firsthand that this officer has made other mistakes in procedures and judgment. I think Lacey PD is better off without him.
mikee September 09, 2011 at 08:01 PM
I have a question, why was his gun out of the holster?
silvio September 23, 2011 at 10:50 PM

John October 12, 2011 at 01:41 AM
1: the reason no charges was because, it was an accident!!! 2: If I remember right they had returned from training.
John October 12, 2011 at 01:41 AM
no inside info by anyone..., IT WAS REPORTED ALL OVER THE PAPERS AND NEWS THAT THEY HAD RETURNED FROM TRAINING!
John October 12, 2011 at 01:43 AM
Pam please..., I would say is because, he accidentially shot his co-worker and it would have been hard for him to return and people there trust him.
John October 12, 2011 at 01:46 AM
He is a great guy and I always enjoy seeing him!
John October 12, 2011 at 01:51 AM
Pam..., really "set up," he accidently fired his weapon!! I like him but, nobody accidentially fired it for him!! And you need to stop seeing RACISIM behind every corner! I get tired of hearing it and seeing it from people "oh I wasn't hired cause I black...," maybe you just don't make it and crap happens!!!
John October 12, 2011 at 01:55 AM
I have one question..., HOW DID YOU SEE THE TAPE???
