Beachwood Man With Multiple DUI Convictions Arrested For Driving On Suspended List


Lacey police recently arrested a Beachwood man who was driving while on the suspended list for multiple previous driving under the influence offenses, Police Chief David A. Paprota said.

Special Officer Jesse Urban conducted a traffic stop in the parking lot of the Walmart on Route 9 North in Lanoka Harbor at 11:11 a.m. on May 8.

Urban determined that the driver, Francis Burke, 67, Ensign Avenue, was driving while on the suspended list for a number of previous drunk driving offenses, the chief said.

Burke was taken to police headquarters and charged with the fourth degree criminal violation and also charged with driving on the suspended list and failure to install an ignition interlock device, Paprota said.

@Spooner: analogously to what I said above, the state can yell from the roof tops that the 5th Amendment does not apply to DWI because it is a violation rather than a crime, but this is mere semantics and disingenuous semantics at that. By designating a crime a violation the state is trying to circumvent Constitutional protections. NJ's TBRs have probably endorsed this tactic, but it is still invalid nonetheless.

In Theory it should work that way...But case law supports the State here.

You are correct @CVV. This is why we need to learn the power of jury nullification. Modern judges hate it, but it has a long and rich tradition of use in free countries.

@ Leo, no one defended the DWI, or the printing of his name, it was the printing of his relatives name that everyone took offense too.
